Yes, they are bound by the GPL to publish their changes if anyone asks for them. But since they've registered a sourceforge project they will probably publish all their changes anyway, sourceforge does not like to host projects that don't publish their source. ;)
They even removed the 5DWM project when they refused to upload their sourcecode until SGI would approve it. (http://5dwm.org/)
