First Swede Convicted of Filesharing Cleared

Swedish appeal court Svea Hovrätt cleared a 29-year old man from Västerås today. He was convicted in a lower court for uploading the Swedish movie Hip Hip Hora. The lower court ruled he did not have any financial gain in the filesharing and convicted him to a fine of 16000 SEK. Today he was cleared after appeal to a higher court. The court didn't accept the evidence provided by Swedish Anti Piracy Authority as beeing enough. All they had was screenshots with IP-addresses. Filesharing have never ever led to jail in Sweden and therefore the police may not do a house search. This means they can't seize any computers.

This means that even more evidence is needed to convict the one million Swedish fileshares. The Swedish Pirate Party welcomes the court's decision. The Pirate Party got 0.6% (34918) of the votes in the Swedish Parliament Election two weeks ago.

I'm not sure, but with the clearing, it's again free for the police to do house searches and seize computers, as we still not really don't know what the maximum penalty can be for this "crime", with harder evidence it could lead to that someone gets 6months or more in jail, which would make this to a "major crime", which would give the police the right for house searches and size computers in future cases. IMHO it had been safer for all if the conviction had staied, with a lower fine.

OT: One question parties suxx and PP IMHO had a quite lousy image, felt more like rich kids trying to become PM's and earn 48000SEK/month by doing nada.
